1 Acceptance of Terms

By creating an account on Thervise, activating a GPS device, or accessing any part of the Thervise platform (website, web app, or mobile app), you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you must not use the Thervise platform. If you are using Thervise on behalf of a company or organisation, you represent that you have authority to bind that organisation to these terms.

2 Description of Service

Thervise is a real-time GPS tracking platform that allows you to:

• Register and activate GPS tracking devices ("Devices") using a unique scratch-off activation code.
• View live location, speed, and status of your registered Devices on an interactive map.
• Access GPS position history and route replay for your Devices.
• Receive geofence and motion alerts for your Devices.
• Manage account settings, language preferences, and notification options.

Features available to you depend on your subscription tier. We reserve the right to modify, add, or remove features at any time with reasonable notice.

3 Account Registration & Security

To use Thervise you must register an account. You agree to:

• Provide accurate, complete, and current information at registration.
• Keep your password secure and not share it with others.
• Notify us immediately at [email protected] if you suspect unauthorised access to your account.
• Be responsible for all activity that occurs under your account.

You must be at least 16 years old to create an account. Accounts created by persons under 16 will be terminated.

4 Device Activation & Ownership

Each Thervise GPS device is provisioned with a unique scratch-off activation code. By entering this code, you claim ownership of the device and all GPS data it generates will be associated with your account.

• Each device can only be activated by one account at a time.
• You are responsible for ensuring you have legal right to track any vehicle or asset on which you install a device.
• Tracking a person or vehicle without their knowledge or consent may be illegal in your jurisdiction. Thervise is not liable for any unlawful use of the platform.

5 Acceptable Use

You agree not to use the Thervise platform to:

• Track individuals without their explicit consent where required by law.
• Circumvent or attempt to bypass any security measures on the platform.
• Reverse engineer, decompile, or disassemble any part of the Thervise platform.
• Interfere with or disrupt the platform's servers or networks.
• Upload malicious code, viruses, or any harmful software.
• Use the platform for any unlawful, harmful, or fraudulent purpose.
• Impersonate another person or misrepresent your affiliation with any entity.
• Share your account credentials with third parties.

Violation of these terms will result in immediate account suspension or termination.

6 Subscriptions & Payment

Access to Thervise features may require a paid subscription. Subscription details, pricing, and billing cycles are presented at the time of purchase and on your account settings page.

• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds are handled on a case-by-case basis. Contact [email protected].
• We reserve the right to change pricing with 30 days' notice.
• Failure to pay may result in suspension of your account and device tracking.

7 Your Data & Intellectual Property

Your data belongs to you. GPS location data, device data, and account data generated by your use of the platform remains your property. We do not claim ownership of your data.

You grant Thervise a limited, non-exclusive licence to store, process, and display your data solely for the purpose of providing the service to you.

All Thervise platform code, design, trademarks, and content (excluding your data) are the intellectual property of Thervise — Systems & Technology Infrastructure and may not be copied, modified, or distributed without written permission.

8 Disclaimer of Warranties

We do not warrant that:

• The service will be uninterrupted, error-free, or available at all times.
• GPS location data will be 100% accurate at all times (GPS accuracy depends on hardware, signal, and environmental conditions).
• The service will meet all your specific requirements.

9 Limitation of Liability

To the maximum extent permitted by applicable law, Thervise shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or business opportunities.
• Damage arising from GPS inaccuracies, service outages, or data loss.
• Losses resulting from unauthorised access to your account.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid us in the 3 months preceding the claim.

10 Termination

You may close your account at any time by contacting [email protected]. Upon closure, your GPS history and personal data will be deleted within 90 days.

We may suspend or terminate your account immediately if you:

• Breach any provision of these Terms of Service.
• Fail to pay applicable subscription fees.
• Engage in conduct that we reasonably believe is harmful to other users, the platform, or third parties.

11 Changes to These Terms

We may update these Terms of Service at any time. Material changes will be communicated by email to your registered address at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.

12 Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes shall be subject to the exclusive jurisdiction of the courts in the territory where Thervise is registered.
