Terms of Service

In plain language: use Thervise and your Thervise-GPS to locate the vehicles you are entitled to track — and tell the people who drive them. Have the Thervise-GPS installed properly. The service is provided "as is": satellites and mobile networks (Mobilis, Djezzy, Ooredoo) can fail, and we are not liable for what we do not control. Algerian law applies and Algerian courts decide disputes.

1 Acceptance of Terms

By creating an account, activating a Thervise-GPS, or using any part of the Thervise platform (website, web app or mobile app), you agree to these Terms of Service and to our Personal Data Protection Policy (Law No. 18-07). Together they form a contract concluded electronically, governed in particular by Law No. 18-05 of 10 May 2018 on electronic commerce.

If you do not agree, do not use the platform. If you use Thervise on behalf of a company or organisation, you declare that you are authorised to bind it to these terms.

2 Description of the Service

"Thervise-GPS" means the Thervise vehicle tracking device: the unit fitted in a vehicle, with its SIM card and its firmware. Thervise is the platform that shows what your Thervise-GPS reports. It lets you:

  • Activate a Thervise-GPS with its unique scratch-off activation code.
  • See the live location, speed and status of your vehicles on a map.
  • Look back at the position history and replay routes.
  • Receive alerts (zones, movement, speed, a tracker going silent) by e-mail, Telegram and in the app.
  • Manage your account, languages and notifications.

The features available depend on your plan. We may add, change or remove features, with reasonable notice when they are part of what you pay for.

3 Account Registration & Security

To use Thervise you must register an account. You agree to:

  • Provide accurate, complete and current information.
  • Keep your password secret and not share it with anyone.
  • Tell us at once at [email protected] if you suspect someone else is using your account.
  • Be responsible for everything done under your account.

You must be at least 19 years old (the age of majority in Algeria) to create an account. Accounts opened by minors will be closed.

4 Activating a Thervise-GPS

Each Thervise-GPS comes with a unique scratch-off activation code. Entering it links the Thervise-GPS to your account: the positions it sends are then associated with your account.

  • A Thervise-GPS is active on one account at a time.
  • When you hand a Thervise-GPS on (a sale, a gift), you choose whether its history is removed or kept with it; either way its next owner sees none of it — see the Personal Data Protection Policy.

5 Hardware & Installation

Installing and wiring the Thervise-GPS — its power supply, its connection to the vehicle's electrical system and the place where it is fitted — is the responsibility of the vehicle owner or of the certified installer they choose, following Thervise's installation instructions.

  • Thervise is not responsible for damage to the vehicle, its electrical system or the Thervise-GPS caused by an installation, wiring or modification that does not follow these instructions, nor for a malfunction that results from it.
  • Do not open, modify or reprogram the Thervise-GPS, and keep its activation code secret.
  • To locate the vehicle and report it, a Thervise-GPS needs a working power supply, mobile network coverage and a view of the sky.

This does not affect the legal guarantee that the Thervise-GPS benefits from as a product under Law No. 09-03 on consumer protection and its implementing texts.

6 Acceptable Use & Consent (Law No. 18-07)

You may only track vehicles that you own or that the law entitles you to track.

Fleet managers and business users: before tracking a vehicle driven by an employee or a driver, you must inform that person and obtain their consent, in accordance with Law No. 18-07 on the protection of personal data and Algerian labour law. For your drivers' data you act as the controller (responsable du traitement); Thervise processes it on your behalf and on your instructions.

The same applies to anyone else who drives the vehicle (a family member, a borrower): tell them beforehand that it is fitted with a Thervise-GPS.

It is strictly prohibited to use Thervise to:

  • Track a person without their knowledge, or carry out any illegal tracking or unauthorised surveillance.
  • Track a vehicle you have no right to track.
  • Circumvent the platform's security or try to reach other accounts.
  • Reverse engineer, decompile or disassemble the platform or the Thervise-GPS firmware.
  • Disrupt the platform, its servers or networks, or upload malicious code.
  • Use the platform for any unlawful or fraudulent purpose, or impersonate someone.
  • Share your sign-in details with third parties.

Unlawful tracking can be a criminal offence under Algerian law (in particular the protection of private life). Thervise may suspend or close an account used that way and answers lawful requests from the authorities. You alone are responsible for how you use the platform.

Reporting a vehicle stolen. The «Report stolen» button alerts the police accounts at once and shares the vehicle's live position with them. You are responsible for every report you make: report only the real theft of a vehicle you are entitled to track. A false report is a false alert to the police services; under Algerian law it may lead to criminal prosecution, and to your liability for the harm it causes. Thervise keeps a record of every report (who made it, and when), may suspend the account that made a false one, and answers lawful requests from the authorities about it.

7 Prices, Payment & Purchases (Law No. 18-05)

  • The prices of plans and of the Thervise-GPS are shown in Algerian dinars (DZD), all taxes included, before you order, together with what they include.
  • Every order and every payment is confirmed in the app and by e-mail.
  • A plan lasts for the period you paid for; its end date is shown in your account. When it ends, the service for that Thervise-GPS stops until you renew it.
  • We may change prices with 30 days' notice; a change never affects a period already paid.
  • If a delivered Thervise-GPS does not match your order or is defective, you may return it within four (4) working days of its actual delivery, as provided by Law No. 18-05, at our cost; we will then deliver a conforming device, repair it, or refund you.
  • Beyond the rights the law gives you, refunds of plans are handled case by case: [email protected].
  • If a payment is not made, the service for the Thervise-GPS concerned may be suspended.

8 Your Data & Intellectual Property

Your data belongs to you. The location data, vehicle data and account data your use of the platform produces remain yours. You grant Thervise a limited, non-exclusive licence to store, process and display them solely to provide the service to you.

Personal data. We process your personal data with your consent and in accordance with Law No. 18-07 of 10 June 2018 on the protection of natural persons in the processing of personal data, as described in our Personal Data Protection Policy (in Arabic, French and English). You can exercise your rights of access, rectification, erasure and objection, and withdraw your consent, at any time — see your rights.

The platform's code, design, trademarks and content (excluding your data), and the Thervise-GPS firmware, are the intellectual property of Thervise — Systems & Technology Infrastructure and may not be copied, modified or distributed without written permission.

9 Service Availability

We aim for high availability of the platform, 24 hours a day. The service may nevertheless be interrupted for maintenance, updates, security reasons or a server incident. We announce planned maintenance in advance when we can (in the app or by e-mail) and restore the service as fast as reasonably possible.

Temporary maintenance windows or server downtime do not constitute a breach of these terms. A Thervise-GPS keeps the positions it records while it cannot reach us and sends them when it reconnects.

10 Service Provided "As Is"

Within the limits of Algerian law, the Thervise platform and the location data are provided "as is" (en l'état) and "as available", without any warranty other than those the law imposes.

In particular, we do not guarantee that:

  • the service will be uninterrupted or free of errors;
  • positions will be exact at all times — accuracy depends on the GNSS satellites (GPS, Galileo, GLONASS, BeiDou), the mobile network, the installation and the surroundings (tunnels, garages, buildings);
  • the service will meet every need you have.

11 Limitation of Liability

Within the limits permitted by Algerian law, Thervise is not liable for:

  • indirect damages;
  • lost, stolen or damaged cargo or goods carried in the vehicle;
  • vehicle accidents, and the consequences of the way a vehicle is driven;
  • loss of profits, revenue, business or opportunity;
  • interruptions, delays or errors of the mobile networks run by telecom operators (such as Mobilis, Djezzy, Ooredoo), or of satellite / GNSS networks — Thervise does not operate them;
  • damage resulting from an installation that does not follow section 5, or from a use contrary to section 6;
  • the consequences of your sign-in details being shared or not kept secret.

Thervise is not an emergency service: in case of theft or danger, call the police or the emergency services — the stolen-vehicle tools in the app help them.

Where Thervise is liable, its total liability for any claim is limited to the amounts you paid for the service during the 3 months before the claim.

Nothing in these terms excludes or limits Thervise's liability for intentional fault (dol) or gross negligence (faute lourde), nor the rights the law guarantees to consumers (Law No. 09-03 on consumer protection, Law No. 18-05 on electronic commerce).

12 Ending the Service

You can close your account at any time in Settings → Account → Delete my account, or by writing to [email protected]. Your GPS history and personal data then leave the Service at once and are kept 12 months in a closed archive before being erased; payment records are kept as the law requires — see the Personal Data Protection Policy.

We may suspend or close an account if you:

  • breach these terms, in particular section 6;
  • fail to pay;
  • act in a way that harms other users, the platform or third parties.

Unless the situation is urgent or unlawful, we warn you first.

13 Changes to These Terms

We may update these terms. Material changes are sent to your e-mail address and shown in the app at least 14 days before they take effect. If you do not accept them, you can close your account before that date; continuing to use the service afterwards means you accept them.

14 Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the People's Democratic Republic of Algeria, and any disputes shall be subject to the exclusive jurisdiction of Algerian courts.
